This contract is intended to be a simple agreement to set out the terms and conditions for the hire of equipment and services from the Company to the Hirer. This service includes the delivery, set up and collection of the equipment unless otherwise stated in the quote. It does not include the engineering of the equipment or instructions on how to use the equipment unless a sound engineer has been requested and paid for by the Hirer.

Delivery and Set Up Costs
There is free delivery, set up and collection of audio equipment on orders where the cost of the renting the audio equipment is over four hundred and fifty euros. For orders below this amount, there may be additional delivery/collection charges. Our normal working hours are from 9am until 8pm. Delivery or pickup outside these hours may incur and extra charge and will be by prior arrangement only.

Hire period
The hiring period commences at 12:00hrs on the first date of the hire period unless otherwise specified in the order confirmation and hire contract. The hire period terminates at 12:00hrs on the last date of the hire period unless otherwise specified in the order confirmation and hire contract. If access is not possible and delivery is delayed, waiting shall be charged at 20Euro/hr. After waiting for 1 hr the company has the right to return to base and charge for 1 days rental. If the company is not able to gain access to make collection, the Company has the right to charge an extra day at the same rate as the hire. Please note orders placed within 48 hours of the drop off time cannot be guaranteed.

Payments
The company requires a 25% deposit payment (or otherwise staded on writting) to secure the booking and the balance at the end of sound check unless agreed otherwise in writing.
 The company reserves the right to remove the equipment at the end of sound check if this condition is not met. Cancellation of a booking will result in the loss of the hirer’s deposit. The Hirer shall in no circumstances remove the equipment from the delivery address without obtaining the consent of the Company in writing. The deposit paid will not be refunded under any circumstance, if for force majeure the event can’t happen the only option is to save the deposit for a future date, but it would never under any condition be refunded.For certain higher value reservations, where there is reason to believe that the booking may be a risk (eg little or no of communication from the hirer)Ibiza Pro DJ, at its sole discretion, may pre-authorise 50% or 100% of the payment on the card used to make the booking.

Customers responsibility
For the duration of the hire, the equipment is under the care and control of the hirer, and they agree to take necessary precautions to ensure the safety and well being of the equipment. This will include the cost of the lost/damaged equipment and the loss of earnings whilst it is not replaced.
The Hirer will not sell or offer for sale, assign, mortgage, pledge, underlet, lend or otherwise deal with the equipment or any parts thereof in a manner prejudicial to the company’s rights, but will keep the equipment in its possession and will not remove the same or any part or parts thereof from the place where the equipment is for the time being and will duly and punctually pay all rents, rates, taxes, charges and impositions payable in respect thereof on demand and will protect the same against distress, execution or seizure and indemnify the Company against all losses, costs, charges, damages and expenses incurred by it by reason or in respect thereof.
The company’s liability in respect of any defect or failure of the apparatus supplied is limited by making good or replacement or repair defects which under proper use and conditions appear therein and arise solely from faulty design materials or workmanship. We are not to be held liable for stoppages or any consequential loss or damage arising out of work done or services rendered under any contract of hire.

Health and safety
High Sound Pressure levels can cause permanent hearing damage. Repeated exposure can have a cumulative effect. Equipment provided by the company can and does produce high enough sound pressure levels to cause hearing damage. The company cannot accept liability for any individual’s failure to stay at an appropriate distance from loudspeakers or failure to take any necessary steps to protect their own hearing. It is the responsibility of the Hirer to ensure the safety, with regards to hearing, of the general public. Where appropriate the customer may wish to ensure that warning notices are displayed, hearing protection is issued, or safety barriers are erected.

Insurance
The Hirer agrees to pay the company the full retail cost of any equipment lost, stolen or damaged beyond economic repair.
The Hirer must arrange their own insurance to cover the equipment, and agree that any loss or damage, direct or in-direct, will be repaid to the Company in full
The Hirer is also responsible for any fines incurred in misuse of the equipment and/or costs in the recovery of the equipment, including any unpaid fines.

Force Majeure
The Company will not be liable for any failure to supply a product or service where that failure is wholly caused by an event we could not reasonably foresee, forestall or prevent. This may include (but is not limited to) acts of war, terrorism, or natural disasters.

Hire Contract
Ibiza Pro DJ is not responsible for any inconvenience that may be caused to neighbors, legality or non-compliance with regulations. This responsibility is subject to the hirer. If the equipment is sealed or immobilized the hirer agrees to pay the fines or costs that this might cause.
The hirer agrees to return the equipment in proper operating condition, same condition the equipment was received and recognizes here.

To book equipment hire for a specified date, the person or entity shall pay 25% of the total rental(or quantity agreed on writting) when booking and the rest on the day event date or first date of rental. In the event that on arrival of IBIZAPRODJ staff to the agreed location with the hired equipment and there was a cancelation, the customer is not entitled to a refund of the reservation.
IBIZAPRODJ is responsible for the delivery or installation of equipment rented in perfect working order, replacing it for the same or similar product in case of damage or foreign customer default.
